虽然目前中国法律没有明文规定外国人在中国就业是否适用我国的劳动合同法,但是《中华人民共和国涉外民事关系法律适用法》第四十三条规定,劳动合同适用劳动者工作地法律;难以确定劳动者工作地的,适用用人单位主营业地法律。从这点上来看,持有就业证的外国人在中国境内就业,与境内用人单位建立劳动关系的,即为中国境内的劳动者,应当完全适用劳动合同法。
Although Chinese law does not explicitly state whether the employmentcontract law of China applies to foreigners employed in China, article 43 ofthe Law of the People's Republic of China on the Laws Applicable to CivilRelations Involving Foreign Countries stipulates that the employment contractshall be governed by the laws of the place of work of the worker; if it isdifficult to ascertain the worker's place of work, the laws of the employer'sprincipal place of business shall apply. From this point of view, foreignersholding employment certificates who are employed in China and who establish alabour relationship with a domestic employer are workers in China and should besubject to the full application of the Labour Contract Law.
此外,外国人在中国就业需要办理就业许可方可就业。根据依据《外国人就业管理规定》第五条“用人单位聘用外国人须为该外国人申请就业许可,经获准并取得《中华人民共和国外国人就业许可证书》(以下简称许可证书)后方可聘用。”
In addition, foreigners need to apply for an employment permit beforethey can be employed in China. According to article 5 of the Regulations on theAdministration of the Employment of Foreigners, "An employer employing aforeigner shall apply for an employment permit for the foreigner, and mayemploy him only after obtaining approval and a Certificate of Permission forthe Employment of Foreigners in the People's Republic of China (hereinafterreferred to as the Permit Certificate)."
可见,外国籍的劳动者在满足许可条件后,依法享有平等就业和选择职业的权利、取得劳动报酬的权利、休息休假的权利、获得劳动安全卫生保护的权利。且与用人单位签订的劳动合同不得违反《劳动合同法》《劳动法》中的规定。
Obviously, the foreign workers, after meeting the licensing conditions,have the right to equal employment and career choice, the right to receivelabor remuneration, the right to rest and take leave, and the right to receivelabor safety and health protection in accordance with the law. The laborcontract signed with the employer shall not violate the provisions of the LaborContract Law and the Labor Law.
