近日，自然资源部对《关于完善不动产登记的若干建议》中“关于农村宅基地使用权登记问题”作出答复：农民的宅基地使用权可以依法由城镇户籍的子女继承并办理不动产登记。根据相关规定，非本农村集体经济组织成员（含城镇居民），因继承房屋占用宅基地的，可按相关规定办理确权登记，在不动产登记簿及证书附记栏注记“该权利人为本农民集体经济组织原成员住宅的合法继承人”。

《中华人民共和国民法典》规定

Article 362  Persons with the right to the use of house sites who, according to law, enjoy the right to possess and use the land owned by the collective, shall have the right to use the land for constructing residences and the facilities to be attached to them according to law.

第三百六十二条  宅基地使用权人依法对集体所有的土地享有占有和使用的权利，有权依法利用该土地建造住宅及其附属设施。

Article 363 The laws on land administration and the relevant State regulations shall be applicable to the obtaining, exercising and transferring of the right to the use of house sites.

第三百六十三条  宅基地使用权的取得、行使和转让，适用土地管理的法律和国家有关规定。
